Privacy Policy

What we collect when you make an enquiry or ask us to arrange finance, what we do with it, who we pass it to, and how long we keep it.

Who we are

Kingfisher Phoenix Finance Ltd is a commercial finance broker registered in England and Wales, company number 17209463. Our registered office and trading address are both Markham House, 20 Broad Street, Wokingham, RG40 1AH.

We are the data controller for the personal information described in this policy. We are registered with the Information Commissioner's Office under registration ZC254965.

What we collect

When you use the enquiry form we collect your name, company name if you give one, email address, telephone number, the amount you want to raise, what it is for, when you need it and anything you write in the free text box.

If we go on to work on a deal for you, we collect a good deal more, because lenders require it. That normally includes:

  • Financial information about the business: filed accounts, management accounts and bank statements
  • Information about property or assets being financed, including valuations and title information
  • Identification documents and proof of address for directors, shareholders and guarantors
  • Credit information, including the results of searches carried out by us or by a lender
  • Details of existing borrowing and of other applications you have made

We also receive technical information that any web server records, such as the address your request came from and the pages you visited. We do not use it to identify you and we do not set cookies on this website.

Why we use it, and our lawful basis

We use your information to respond to your enquiry, to work out what finance is available to you, to prepare and submit an application to lenders, and to see a facility through to completion.

Our lawful bases are:

  • Your consent, for contacting you about an enquiry you have submitted through this website
  • The performance of a contract, or steps taken at your request before entering into one, where we are arranging finance for you
  • Our legitimate interests in running and administering a brokerage, where those interests are not overridden by your rights
  • Legal obligation, for anti-money-laundering checks and record keeping

We do not use your information for automated decision making that produces a legal effect for you. Lenders may use automated decisioning as part of their own assessment, and their privacy notices explain how.

Who we share it with

To arrange finance we share your information with lenders and funders we approach on your behalf. We tell you which lenders we intend to approach before we submit anything, and we do not send your information to a lender without your agreement.

We may also share information with:

  • Credit reference and fraud prevention agencies, whose searches may be recorded against you
  • Valuers, solicitors, accountants and other professionals involved in your transaction
  • Our own service providers, such as email and document storage, acting on our instructions
  • Regulators, law enforcement or other authorities where we are required to do so by law

We do not sell your information, and we do not share it with anyone for their own marketing.

How long we keep it

Where an enquiry does not lead to a deal, we keep the enquiry and our correspondence for up to two years, so that we can pick up the conversation if you come back to us.

Where we arrange a facility, we keep the file for at least six years from the end of our relationship, because anti-money-laundering rules and the limitation period for claims both require it. Some records are kept longer where a facility runs for longer than that.

Your rights

You have the right to ask us for a copy of the personal information we hold about you, to have inaccurate information corrected, and in some circumstances to have information erased or its use restricted. You can object to processing we carry out on the basis of legitimate interests, and you can ask us to transfer information you gave us to another organisation.

Where we rely on your consent, you can withdraw it at any time. That does not affect anything we did before you withdrew it, and it may mean we cannot continue to work on an application for you.

To exercise any of these rights, email admin@kingfisherphoenixfinance.com or write to us at Markham House, 20 Broad Street, Wokingham, RG40 1AH. We will respond within one month.

How we protect it

Documents and correspondence are held in access-controlled systems. Information is sent to lenders through their own secure portals where they provide one. We ask you not to send bank statements or identification documents by ordinary email; we will tell you the secure route when we need them.

If a breach occurs that is likely to result in a risk to your rights, we will report it to the Information Commissioner's Office within 72 hours and tell you where the risk is high.

How to complain

If you are unhappy with how we have handled your information, tell us first at admin@kingfisherphoenixfinance.com and we will look into it. Our complaints procedure sets out the timescales.

You can also complain to the Information Commissioner's Office at ico.org.uk, or by calling their helpline. You do not have to come to us first, although it is usually quicker.

Changes to this policy

We update this policy when what we do with information changes. The date at the top of the page is the date of the current version.
